Western Union® Mobile App Terms of Use.

These Terms of Use apply to your use of the Western Union Mobile App (the “App”). By using the App, you acknowledge, understand and agree that your actions are subject to these Terms of Use. This App is provided by Western Union International Limited, based in Ireland, but the service is provided by Western Union Financial Services Argentina SRL (“Western Union”) and references to “we,” “us” and “our” are references to Western Union. IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THESE TERMS OF USE. BY DOWNLOADING THE APP YOU AGREE TO THESE TERMS OF USE. IF YOU HAVE DOWNLOADED THE APP AND DO NOT AGREE TO THESE TERMS AND CONDITIONS, REMOVE THE APP FROM YOUR DEVICE IMMEDIATELY. IN ADDITION, IF YOU WISH TO WITHDRAW YOUR ACCEPTANCE OF THE TERMS OF USE, YOU MAY DO SO AT ANY TIME AND BY UNINSTALLING THE MOBILE APP. YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT THE TERMS OF USE OF THIS APP MAY BE AMENDED AT ANY TIME. WE MAY MAKE CHANGES TO THESE TERMS OF USE, AND IN THIS CASE WE WILL PUBLISH AN UPDATED VERSION ON THE APP. WE RECOMMEND THAT YOU CHECK THE APP REGULARLY IN ORDER TO REVIEW THE CURRENT VERSION OF THESE TERMS OF USE. YOU ACKNOWLEDGE, UNDERSTAND AND ACCEPT THAT CONTINUED USE OF THE APP WILL BE DEEMED TO BE CONCLUSIVE ACCEPTANCE OF THE MODIFIED TERMS OF USE. Purpose of the App and Services. The App is available to provide you with information and access to the money transfer services offered by means of the Western Union brand (the “Services”). These Services are subject to acceptance of the specific terms and conditions for those Services, as set out below in these Terms of Use (the “Terms and Conditions of Service”). If there is any discrepancy between these Terms of Use and the applicable Terms and Conditions of Service, the Terms and Conditions of Service shall prevail, but only with regard to that discrepancy. This App is currently intended for, and available for use by, Western Union customers only. Depending on the features available in the App in your country, you may not be able to use the App or certain Services until you have registered or logged in to the App. You acknowledge, understand and accept that you may be denied use of the App or have your use restricted at any time. 2. Minors. The App is not intended to be used by, and is not marketed or directed toward, any person under the age of majority in your country. 3. Privacy. Our Privacy Statement, which you can access from the App, describes how we collect, use and disclose personal information. Certain functionalities of the App may need to access your cell phone, tablet or other handheld device (the “Device”) and information stored on it so that it works properly. You acknowledge, understand and agree that by using the App you agree to this access. 4. License. Western Union grants you a limited, non-exclusive, royalty-free, personal, non-transferable, non-sub-licensable and revocable right and license to access, view, use and print the information and documentation that can be accessed in the App, for your personal, non-commercial use and for information purposes only. Except for the limited licenses and rights expressly granted herein, these Terms of Use do not grant you any other right or license in or under any patent, trademark, copyright or other intellectual property or proprietary rights of Western Union. You acknowledge, understand and agree that this license may be canceled at any time and for any reason. 5. Content. The App may include images, texts, works and other content and data owned by third parties (“Third Party Content”). You acknowledge, understand and agree that all of the terms and conditions of these Terms of Use apply to your access to and use of the Third-Party Content, and you agree to comply with the specific terms and conditions for the Third-Party Content. You acknowledge, understand and agree that Third-Party Content is not the responsibility of Western Union. All content and data available through the App are the sole and exclusive property of our company or third parties. You cannot: (a) publish, reproduce or publicly display, communicate to the public, or otherwise distribute to third parties any of its content; (b) market, sell, resell or make commercial use of the App or any of its content; (c) systematically collect or make derivative uses of the App or its content. You acknowledge, understand and agree that by providing us with access to information, data or content on or through the App, including in the event that you contact us, or provide feedback or ideas about our Services or the App, you grant us a non-exclusive, transferable, sub-licensable, irrevocable, royalty-free, perpetual, and worldwide license to store, use, copy, reproduce, modify, adapt, edit, translate, publish, present and display such content, without any payment or restriction. You acknowledge, understand and agree that you will be solely responsible for any content you provide in or through the App or that is available through use of your App account. 6. Intellectual property. The Western Union name and logo, and all logos and names related to the App or Services, are trademarks or registered trademarks of the company (or its affiliates, suppliers, partners or licensors, as applicable). You acknowledge that the App, Services and underlying technology that is used in connection with the Services contain intellectual property and confidential information. You may not use, reproduce, distribute, modify or create derivative works from, publicly display (including the transfer of content) or commercially exploit any part of the App or Services, or of the registered or unregistered trademarks mentioned above, intellectual property or confidential information except where necessary in order to view the content of this document and to create a reasonable number of copies of parts of such content (without modification) for your personal, non-commercial use. Furthermore, all page headers, custom graphics, button icons and command sequences are service marks or trademarks of Western Union. You may not use, reproduce, distribute, modify or create derivative works from them without our prior written consent. All rights, titles and interests in and to the App, its related content, the Services, the technology used in connection with the Services and any other technology or content created or derived from any of the above are the exclusive property of Western Union (or its affiliates, suppliers, associated companies or licensors, as applicable). 7. Usage restrictions. You acknowledge, understand and agree that by using the App you will not: (a) allow any other person to use the App for their benefit; (b) interfere with or circumvent any copyright or other mechanism of technical or reverse engineering protection, decompile, disassemble or dismantle the App or any of its parts, or any software, technology or content that is part of it; (c) take any action or use any program or device that may result in or be intended to interfere with the operation or functioning of the App or close, overload or collapse the website; (d) copy, publish or redistribute any part of the App, cached or otherwise, including through caching, handover or similar means; (e) send it to another person or copy or modify any part of the App in any way; or (f) attempt to extract the App’s source code, disassemble or make derivative versions, or attempt to interrupt or decrypt transmissions between the App and our systems. Furthermore, you acknowledge, understand and agree that you should not use the App for any of the following purposes: (i) purposes that are unlawful or illegal, fraudulent or malicious, or that promote or provide information about criminal activities; (ii) purposes that are defamatory, abusive or threatening, or otherwise infringe or violate the rights of others. This includes any information that you may add or upload to the App; (iii) purposes that interfere in any way with another user of the App; or (iv) purposes that knowingly introduce viruses or other malicious or harmful material or using it in connection with unsolicited communications. 8. Charges and minimum system requirements. You acknowledge, understand and agree that your service provider may charge you for downloading or accessing the App on your Device. These charges may include, but are not limited to, roaming charges if you use the App outside your territory of residence. You acknowledge, understand and agree that all of these charges are your sole responsibility. If you do not pay the bills for your Device, then we assume that you have the permission of the person that does before incurring any of these charges. Western Union will not charge a separate fee for accessing the App, but you acknowledge, understand and agree that you may be charged for use of the Services that may be offered through the App. Western Union will visibly disclose any fees charged for those Services before they are charged to you. The App will only work on supported Devices and operating systems, and certain features will only be available if your Device is connected to the Internet. Some features may also only be available with certain operating systems. 9. Use of cookies. You acknowledge, understand and agree that Western Union may monitor and review your use of the App and Services, and may use cookies, log files and browsing data in accordance with the Privacy Statement. 10. Support. We may provide you with troubleshooting support regarding your use of the App and any of the Services at our sole discretion, but you acknowledge, understand and agree that Western Union is not obliged to do so. 11. The App and Services are provided “as is” and “as available.” You acknowledge, understand and agree that the App and its content, as well as the Services, are provided “as is” and “as available” and, except to the extent expressly provided under the law in force, we renounce all statements or warranties, or conditions of any kind or nature, whether express or implied, and whether arising by law or otherwise in accordance with law, for the course of the trade deal or use, including without limitation, of any implied warranty or condition, any condition or warranty of merchantability, title or non-infringement of the rights of third parties and any condition or warranty of suitability for a particular purpose. 12. Links. We may provide links in the App to other existing resources on the Internet, including those operated by third parties. These links are provided for your convenience and you acknowledge, understand and agree that both the availability of websites and the resources administered by third parties are the responsibility of third parties, for whom Western Union has no obligation to respond. You also acknowledge, understand and agree that the content of such third-party websites or external resources belongs to third parties for whom Western Union has no obligation to respond. Your access and viewing of any third-party websites or resources is carried out at your own risk. 13. Limit of liability. Except where prohibited by the law in force, Western Union and its affiliates, and all of their respective directors, officers, employees, consultants and agencies, shall not be liable for any direct, indirect, incidental, special or consequential damages or any loss resulting from use of, or the inability to use, the App or the Services, or any loss or transfer of any confidential or sensitive data or information. 14. Compensation. You agree to defend, indemnify and hold harmless Western Union and its affiliates from and against any claims, actions, demands, losses, liabilities, damages, costs or expenses incurred due to your failure to comply with these Terms of Use. Western Union money transfers can be sent and collected from most Western Union agencies worldwide. In the Argentine Republic, the Western Union service is provided by Western Union Financial Services Argentina SRL. (“Western Union Argentina”) and its network of subagents. Customers may call 0810-444-1000 to obtain the address and business hours of the nearest office. DELIVERY TIME. Normal funds transfers in which payments are made exclusively in cash at a Western Union branch or agency are made available to the receiver, usually in minutes, depending on the operating hours of the receiving agency. Some countries may be subject to delays and other restrictions. Call 0810-444-1000 for more information. SERVICE OPTIONS. The Services that Customers may use in the App are as follows: (i) “Stage & Pay”: By means of money transfers under the “Stage & Pay” function, the Customer may pre-load the information corresponding to the operation that they wish to carry out through the App. When the pre-load is complete, the Customer must go to a Western Union branch or agency with the cash pre-loaded on the App, along with their ID within 72 (seventy-two) business hours to complete the operation. (ii) “Omni Channel”: By sending money under the “Omni Channel” function, the Customer may upload the information corresponding to the operation that they wish to perform through the App, and, once the information is pre-loaded, the App will issue an MTCN number. In order for the money transfer to be paid to the Receiver in the destination country, outside the App, you must make a bank transfer from your financial institution’s Home Banking to the Western Union bank account detailed below. The transfer must be sent from a bank account held by the Western Union user, with no exception. If you use a third-party bank account, whether an individual or a legal entity, the transfer will be canceled automatically. As such, this transfer may be fully completed so that: 1) The amount to be transferred, from the Customer’s bank account via Home Banking, is credited to the bank account of Western Union Argentina Financial Services SRL with Banco Francés (“Banco Francés”) – Current account: [490-001675/2], Bank ID: [0170490120000000167527], Alias: [WUARGENTINA]. 2) An “Omni Channel” money transfer will be made by Western Union once the amounts pre-loaded on the App have been credited to Western Union’s account within twenty-four (24) hours (interbank business hours). 3) All data provided in the App corresponds to the data provided at the time of transfer. If any of the following occur: (i) if you transfer an amount other than that reported in the App; (ii) if the currency reported in the App does not correspond to the currency in which the transfer is made; (iii) if you use a foreign National Identity Card (DNI) when in the App and for the bank account you are registered with Argentine DNI; (iv) if you use a joint bank account and the first holder does not correspond to the user of the App; (v) if there is a discrepancy between the ownership of the transfer made and the information provided in the App, the bank transfer made by you may not be finalized, as the data provided in the App and the details of the bank account used to make the transfer do not match. , . In any of these cases, if you find that the operation was unsuccessful and has not reached its destination, you should contact our Customer Service Center on 0-8000-800-3030, Monday through Friday, from 08:00 to 22:00, and Saturdays from 08:00 to 14:00. You must provide the Customer Service Center with all information required regarding your transfer and coordinate to reimburse the funds or open a new service request. In all cases mentioned above, payment of the money transfer to the Receiver will be subject to the cash collected by Western Union of the amounts involved in the transaction. PROTECT YOURSELF AGAINST FRAUD: Do not disclose your MTCN number (“Money transfer control number”), even though this has not been made available yet in order to pay the Receiver in the destination country. Once the pre-load has been made, the sender must take the necessary precautions to ensure that no person other than the Receiver obtains information about the money transfer, for example, the name of the sender or receiver, the MTCN or the amount of money sent. Only send sums of money to family members, friends or people you know. MONEY TRANSFER PAYMENT METHOD. ADMINISTRATIVE COSTS. The customer/receiver (hereinafter, interchangeably, the “Customer”) acknowledges and accepts as an essential contractual condition that cash transfers may be paid by Western Union Argentina by check or a combination of cash and check. In certain circumstances, the payment of funds may be subject to local taxes, which shall be entirely payable by the Customer. The amounts corresponding to administrative costs that must be paid for each type of transaction will be displayed in Western Union Argentina network locations or in any other site that is visible depending on the Service required by the Customer, prior to the completion of each transaction. The Customer accepts that payment will be made as long as the Receiver has provided the required personal details at the corresponding Western Union location. FOREIGN CURRENCY CONVERSION. Fund transfers are normally paid in the currency of the destination country (in some countries, payment is available in US dollars or in another alternative currency). The conversion of the money sent into the currency of the destination country shall be made by the sending agency at the exchange rate in force in the destination country at the time when the Sender sends the funds.

. IT IS EXPRESSLY STATED THAT WESTERN UNION ARGENTINA DOES NOT CARRY OUT FOREIGN EXCHANGE TRANSACTIONS IN THE ARGENTINE REPUBLIC. Further information on exchange rates for destination countries may be obtained by contacting the number at the end of these Terms and Conditions. Said information is for information purposes only, since Western Union Argentina provides no foreign exchange transactions in the Argentine Republic. SPECIAL SERVICES. Test questions are only used if the principal amount of the fund transfer does not exceed USD 1000 (one thousand US dollars) or its equivalent in local currency. Different limits may apply to transfers to other countries or coming from other countries. Transfers with test questions may incur additional costs, in which case this cost will be notified in advance. In most countries, the Receiver will be paid the funds that include a test question upon providing the correct response to the test question, depending on local regulations. In Argentina, the test question does NOT replace the requirement to provide valid proof of identity in accordance with the regulations in force. In certain circumstances (mainly regarding money transfer payments to Africa), a test question is required for all transfers (regardless of the principal amount), and the Receiver may also be required to prove their identity. TELEPHONE NOTIFICATION to the Receiver that the fund transfer is available is offered in most countries for an additional fee. COURIER DELIVERY of a check or money order is offered in some countries and selected destinations for an additional fee. SUPPLEMENTARY MESSAGES may be included for an additional fee with fund transfers sent to most countries. In Argentina, transfers may be sent to the Receiver’s cell phone account. This service is available in some countries and with certain cell phone providers. Call 0810-444-1000 for up-to-date information on the use and costs of implementing the TEST QUESTION and TELEPHONE NOTIFICATION services. DELIVERY BY COURIER AND SUPPLEMENTARY MESSAGES AND ACCREDITATION TO CELL PHONE ACCOUNT. REFUNDS AND ADMINISTRATIVE COSTS. Western Union Argentina will reimburse the principal amount of the fund transfer, upon written request by the Sender, if payment to the Receiver is not made within 45 days due to reasons beyond the control of Western Union. Western Union Argentina will reimburse the fund transfer fee to the Sender, upon written request by the Sender, if it is verified that the funds were not available to the Receiver within the time frame specified by the chosen service, subject to the business hours of the agency selected for the payment and other conditions, including conditions beyond the control of Western Union or its agents, such as, inter alia, inclement weather or telecommunications problems. THE CUSTOMER ACKNOWLEDGES AND ACCEPTS THAT OPERATIONS MADE THROUGH WESTERN UNION ARE SUBJECT TO CERTAIN LIMITATIONS AND DELAYS INHERENT TO ALL MONEY TRANSFER SERVICES. THE CUSTOMER DECLARES UNDER OATH THAT THE MONEY TRANSFER ORDERED COMPLIES WITH THE RULES IN FORCE. BE CAREFUL WHEN SENDING MONEY TO SOMEONE YOU DON’T KNOW. YOU ARE THE ONLY PERSON RESPONSIBLE FOR DESIGNATING THE RECEIVER. WESTERN UNION ARGENTINA DOES NOT GUARANTEE THE DELIVERY OR PROPER CHARACTER OF ANY GOOD OR SERVICE PAID FOR THROUGH A FUND TRANSFER INTERMEDIARY OF WESTERN UNION. The Customer hereby declares that they have read, understood and fully consented to the regulations governing the transfer of money through Western Union, and that they therefore agree to comply strictly with said regulations. Western Union and its network of agencies may refuse to accept, process or pay any fund transfer that they deem to be in breach of the legislation in force or the rules governing the transfer of money through Western Union. OPERATION CONTROL. The legislation in force prohibits money transferors from carrying out transactions with certain individuals and countries. In order to comply with these requirements, Western Union must examine all transfers in relation to lists of names provided by the governments of the countries and territories in which Western Union operates, including lists provided by the Financial Information Unit, the US Treasury Department Office of Foreign Affairs Assets Control (OFAC) and the European Union. If a possible equivalence is identified, Western Union must investigate the transfer to determine whether the individual detected is the individual listed. Customers will sometimes be asked to provide identification or additional information. This may delay transfers, or even prevent a transfer from taking place. This is a legal requirement for all transfers processed by Western Union (including transfers originating and ending outside the US). In addition, and at the sole discretion of Western Union, the Customer accepts that maximum daily transfer and payment limits may exist in the different jurisdictions. In the event that a Customer makes transfers in more than one location that together exceed the established limit, payment of such excess transfers will not be processed by Western Union, regardless of the receipt of funds by the location of origin. WESTERN UNION DATA PROTECTION STANDARDS. The Customer provides free and informed consent for Western Union Argentina to proceed with the processing of their personal data. The Customer hereby agrees that Western Union Argentina may transfer or disclose information regarding their money transfers to third parties, located both in Argentina and abroad, including, inter alia, jurisdictions that do not have the same level of personal data protection as in Argentina. Information disclosed to third parties may include data describing fund transfers made by Western Union Argentina and other information beyond merely personal data about the individuals sending and receiving.

 

Western Union Argentina may provide such information to financial institutions, such as banks and credit card companies; retail stores; home furnishing stores and clothing stores; companies that process transfers or provide services to Western Union Argentina or its affiliates; government bodies; and mail order companies and other direct traders, whether in Argentina or abroad. You may choose not to disclose certain information (or give us instructions so that the information provided is not disclosed), (*) unless the information must be presented to the appropriate authorities. You will also be able to access our database in order to verify the Information on you that we retain, to request the rectification of any data that is incorrect or inaccurate and, finally, to request that it be deleted, by contacting 0810-444-1000. The holder of the personal data has the power to exercise the right of access to it free of charge at intervals of no less than six (6) months, unless a legitimate interest is credited to that effect in accordance with Article 14, paragraph 3 of Argentine Law No. 25.326. The DIRECCIÓN NACIONAL DE PROTECCIÓN DE DATOS PERSONALES (Argentine National Directorate for the Protection of Personal Data), the Control Body for Argentine Law No. 25.326, is responsible for dealing with complaints and claims arising in connection with non-compliance with the personal data protection standards. (*) Should the competent authority request information regarding money transfers or customer data, Western Union Argentina may send said information to the requesting authorities, and this Western Union Privacy Policy shall be void. Pursuant to the provisions of the PEP Regulation (Article 8, FIU Resolution 35/2023), we are obliged to report on its content so that the Customer can state if they are included on the list of persons established in Articles 1 to 4, stating accordingly before carrying out your transaction. Neither Party shall use or disclose confidential information about the other Party without its prior written consent, except where the purpose of the use or disclosure is to comply with the obligations set forth in these Terms and Conditions of Service, or if required by applicable laws or regulations or a court order, in which case, the Party that is obliged to disclose the confidential information shall, as far as is reasonable, notify the other Party as soon as possible, prior to sharing the confidential information. MISCELLANEOUS. APPLICABLE LAW AND JURISDICTION.

 

Western Union Argentina will be exempt from fulfilling the money transfer service if such fulfillment is prevented, delayed or obstructed by reasons beyond its reasonable control. These Terms and Conditions of Service (including any amendments agreed by the Parties in writing) constitute the entire agreement between you and Western Union Argentina relating to the subject matter hereof, and replace all prior agreements and statements between the Parties in this regard. If any provision of this Service is deemed unenforceable for any reason, this provision shall be amended to the extent necessary so that it is implemented to the maximum extent possible, in order to fulfill the intent of the Parties; the remainder of these Terms and Conditions of Service shall continue in full force. These Terms and Conditions of Service shall be governed by and construed in accordance with the laws of the Argentine Republic, without its conflict of laws principles applying. In the event of conflicts between foreign laws, rules and regulations and the laws, rules and regulations of the Argentine Republic, the laws, rules and regulations of the Argentine Republic shall prevail and govern. You may not assign or otherwise transfer any of your rights described in these Terms and Conditions of Service without the prior written consent of Western Union Argentina, and any such attempt will be deemed invalid. The relationship between you and Western Union Argentina is not that of a legal company, but one of independent contractors. Each Party undertakes to submit to the exclusive and personal jurisdiction of the courts located in the City of Buenos Aires. A waiver of any act or exercise of rights in light of a breach shall not be deemed a waiver of any action or exercise of any right in light of any subsequent breach. WESTERN UNION FINANCIAL SERVICES ARGENTINA S.R.L. In order to provide the money transfer service in the Republic of Argentina, Western Union Financial Services Argentina S.R.L, with registered address at Montevideo 825, Capital Federal, Argentina, uses its network of subagents, which will invoice the respective charge to the Customer, and it is the obligation of the Customer to request the corresponding invoice from the subagent when the transfer is carried out. The Western Union money transfer service is provided: (I) by Western Union Financial Services, Inc., a company incorporated and existing in accordance with the laws of the United States of America (for transfers to and from the United States, Canada and Mexico, and commercial services); or (II) by Western Union International Limited, a company incorporated and existing in accordance with the laws of the Republic of Ireland (for all other money transfers), in both cases through a worldwide network of authorized agencies and representatives © 2018 WESTERN UNION HOLDINGS, INC.
