ON THE FOLLOWING TERMS AND CONDITIONS

 

IMPORTANT NOTICE: THE TERMS AND CONDITIONS ON WHICH THE MONEY TRANSFER SERVICE IS PROVIDED ARE SET OUT BELOW. YOU ARE REQUIRED TO READ AND UNDERSTAND THESE TERMS AND CONDITIONS, ESPECIALLY THOSE DESCRIBING CONDITIONS FOR PAY_OUT, RESTRICTING LIABILITY AND DATA PROTECTION, BEFORE THE SEND MONEY TRANSACTION IS MADE. IN ADDITION TO THE TRANSFER FEE, WESTERN UNION AND ITS REPRESENTATIVES ALSO MAKE MONEY FROM THE EXCHANGE OF CURRENCIES. PLEASE SEE FURTHER IMPORTANT INFORMATION REGARDING CURRENCY EXCHANGE AND LEGAL RESTRICTIONS THAT MAY DELAY THE TRANSACTION SET FORTH BELOW. PROTECT YOURSELF FROM CONSUMER FRAUD. 1. Western Union® Money Transfer transactions can be sent and picked up at most Western Union® Representative (“Representative”) locations worldwide. Customers may call the number indicated in Clause 15 below for the address and hours of nearby locations. Some locations are open 24 hours.

2. Regular money transfers are usually available within minutes for pick up by the receiver, subject to the opening hours of the receiving Representative location. The maximum completion time for regular money transfers is 15 minutes subject to the provisions of Clauses 3 and 5 below. The Next Day/2 Day and account-based money transfer services are available upon request to limited countries. The maximum completion time for the Next Day/2 Day money transfer service is 24 and 48 hours respectively subject to the provisions of Clauses 3 and 5 below. Account-based transfers generally take 5 business days maximum subject to the provisions of Clauses 3 and 5 below. The maximum completion time for transfers to mobile wallets is 15 minutes subject to the provisions of Clauses 3 and 5 below.

3. Exceeding amount limitations, regulatory restrictions or other restrictions in certain countries may delay the transaction. Western Union does not act as the representative of any bank for any purpose and does not accept deposits on behalf of any bank. For details please call the number indicated in Clause 15 below.

4. Money transfers will normally be paid in cash, but some Representatives will pay by cheque or a combination of cash and cheque or may offer or the receiver may choose other ways to receive funds and some money transfers may be paid to accounts. All cash payments are subject to availability, receivers showing documentary evidence of their identity and providing all details about the money transfer required by Western Union, including sender’s and receiver’s names, country of origin, money transfer control number, approximate sum and any other conditions or requirements applicable at the Representative location.  The sender authorizes Western Union to honor the receiver’s choice of method to receive funds even if it differs from the sender’s. Cash money transfers shall be paid to the person that Representatives deem entitled to receive the transaction after verification of identity often through examination of identification documents in accordance with the applicable law. Such payment can be made even when the form filled out by the receiver contains errors. Neither Western Union nor its Representatives carry out a comparison of the “To Send Money” form against the “To Receive Money” form to verify the address given for the receiver. The receiver will be required to provide identification to receive funds in cash. Senders may have the option to ask a test question in which case the receiver may also be required to provide a test answer. A test question and answer is mandatory for all money transfers to South Africa. Test questions are not an additional security feature and cannot be used to time or delay the payment of a transaction and are prohibited in certain countries.

5. Applicable law prohibits money transmitters from doing business with certain individuals and countries. Western Union is required to screen all transactions against lists of names provided by the governments of the countries in which we do business, including the US Treasury Department’s Office of Foreign Assets Control (OFAC) and the European Union. If a potential match is identified, Western Union researches the transaction to determine if the name matched is the individual on the relevant list. On occasion, customers are required to provide additional identification or information, delaying transactions compared to the maximum completion time indicated in Clause 2 above. This is a legal requirement for all transactions processed by Western Union (inclusive of transfers that originate and terminate outside of the US).

6. TRANSFER FEES – Written information explaining how Western Union charges the sender for making a money transfer will be shown to the sender prior to completion of the payment order. Unless applicable law in the destination country requires otherwise, the sender will bear all fees for the money transfer. In certain cases, payment of a money transfer may be subject to local taxes and service charges.

7. FOREIGN EXCHANGE: Money transfer payments will normally be made in the currency of the destination country (in some countries payment is available only in U.S. dollars or other alternate currency). In addition to the transfer fee applicable to each transfer and if the currency which the sender presents to a Representative is not the currency to be received by the receiver, all currency is converted at Western Union’s then current rate of exchange. The currency will be converted at the time of transfer and the receiver will receive the foreign currency amount shown on the receipt. In a few countries local regulations require the currency to be converted at the time the receiver is paid, in which case the exchange rate and any amounts shown on this form may be subject to exchange rate fluctuations between the time of transfer and the time the receiver collects the funds. Western Union calculates its rate of exchange based on commercially available interbank rates plus a margin. Most rates of exchange are adjusted several times daily in line with the relevant closing rate of global financial markets. The exchange rate applied may be less favorable than some publicly reported commercial exchange rates used in transactions between banks and other financial institutions. Any difference between the currency exchange rate offered to customers and the currency exchange rate received by Western Union will be kept by Western Union (and, in some instances, its Representatives) in addition to the transfer fees. 8. Sending and receiving in countries that provide payment in multiple currencies: Senders must select the currency of payment at the time the send money transaction is made. The transfer fee and the money Western Union (or its Representatives, mobile phone or account provider) makes when it changes the funds into foreign currency may vary based upon the payment currency selected. In some countries it is possible to decide to receive the funds in a currency different from the one that the sender selected. Western Union (or its Representatives, mobile phone or account provider) may make additional money when your funds are converted into the currency selected by the receiver.

9. SPECIAL SERVICES

9.1. TELEPHONE NOTIFICATION to the receiver that the money transfer is available for pick up is offered in most countries for an additional fee. MESSENGER DELIVERY of a cheque or a bank draft is available in some countries to selected destinations for an additional fee. SUPPLEMENTAL MESSAGES may be included for an additional fee with money transfers sent to most countries.

9.2. SMS – Where available, Western Union offers free SMS notification to indicate that the transaction has been collected by the receiver (for the sender) or that funds are available for collection (for the receiver). Charges applied by the service provider are the exclusive responsibility of the sender or receiver. To the extent permitted by applicable law, the SMS will be sent to the sender’s and/or receiver’s mobile number provided on the receipt. Western Union will send SMS messages to a third party gateway for delivery. To the extent permitted by applicable law, Western Union is not responsible for undelivered SMS or technical malfunctions that occur outside of its proprietary systems.

9.3. ACCOUNT BASED TRANSFERS – Where available, the receiver may incur additional fees for receiving the sender’s funds through a mobile telephone or to a bank or other account. Transfers should be sent to a local (receiver) currency account, otherwise the receiving institution may convert the funds at its own exchange rate or reject the transaction. The receiver’s agreement with its mobile phone service, mWallet, bank or other account provider governs the account and determines their rights, liability, fees, funds availability and account limitations. In the event that the account number provided (including mobile phone numbers for mobile accounts) does not belong to the named receiver, the transfer will be credited to the account number provided by the sender. Western Union may make money from fees associated with use of an account. To the extent permitted by applicable law, Western Union accepts no responsibility to the sender nor to any account holder for any fees, exchange rates used for conversion to non-local currency, acts or omissions of the destination or intermediary financial service providers.

10. REFUND – Western Union will refund the principal amount of a money transfer (at the applicable exchange rate described herein in effect at the time the refund is made) upon the written request of the sender if payment to the receiver is not made or credited within 45 days. Transfer fee refunds are made upon sender’s written request if the money transfer is not available to the receiver within the time specified for the selected service, subject to the business hours of, and availability of funds at, the location selected for payment and other conditions, including, without limitation, conditions beyond the control of Western Union or its Representatives, such as inclement weather or telecommunications failure. Transfer fees are not refunded if the transfer is stopped at the sender’s request. Payment of some money transfers may be delayed as a result of the application of United States or other applicable laws. To the extent allowed by law, Western Union may deduct an administrative charge from money transfers that are not picked up within one year of the send date.

11. LIABILITY – WESTERN UNION DOES NOT GUARANTEE THE DELIVERY OR SUITABILITY OF ANY GOODS OR SERVICES PAID FOR BY MEANS OF A WESTERN UNION MONEY TRANSFER. THE SENDER’S TRANSACTION DATA (INCLUDING MTCN) IS CONFIDENTIAL TO HIM AND SHOULD NOT BE SHARED WITH ANY OTHER PERSON OTHER THAN HIS RECEIVER. THE SENDER IS CAUTIONED AGAINST SENDING MONEY TO ANY PERSON HE DOES NOT KNOW. IN NO EVENT SHALL WESTERN UNION OR ANY OF ITS REPRESENTATIVES BE LIABLE IF THE SENDER COMMUNICATES TRANSACTIONAL DATA TO ANY PERSON OTHER THAN HIS RECEIVER. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WESTERN UNION OR ANY OF ITS REPRESENTATIVES BE LIABLE FOR DAMAGES FOR DELAY, NONPAYMENT OR UNDERPAYMENT OF A MONEY TRANSFER, OR NON-DELIVERY OF ANY SUPPLEMENTAL MESSAGE, WHETHER CAUSED BY NEGLIGENCE ON THE PART OF THEIR EMPLOYEES OR REPRESENTATIVES OR OTHERWISE, BEYOND THE SUM EQUIVALENT TO US$500 (IN ADDITION TO REFUNDING THE PRINCIPAL AMOUNT OF THE MONEY TRANSFER AND THE TRANSFER FEE). TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WESTERN UNION OR ITS REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. THE FOREGOING DISCLAIMER SHALL NOT LIMIT WESTERN UNION’S OR REPRESENTATIVE’S LIABILITY FOR DAMAGES RESULTING FROM WESTERN UNION’S OR REPRESENTATIVE’S GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT [OR OTHER INSTANCES] IN THOSE JURISDICTIONS WHERE SUCH A LIMITATION OF LIABILITY IS VOID.

12. When a Representative accepts a cheque draft, credit or debit card or other non-cash form of payment, neither Western Union nor the Representative assumes any obligation to process or pay the money transfer if the form of payment is uncollectible, nor do they assume any liability for damages resulting from nonpayment of the money transfer by reason of such uncollectibility. To the extent permitted by the applicable law, Western Union reserves the right to change these terms and conditions or the offered service without notice. Western Union and its Representatives may refuse to provide service to any person, in case there is a justified reason.

13. DATA PROTECTION – PRIVACY STATEMENT REGARDING PROCESSING OF PERSONAL DATA OF CUSTOMERS

13.1 Western Union, our subsidiaries and affiliates (“Western Union” or “we” or “us”) care about your privacy and are committed to processing your personal information in accordance with fair information practices and applicable data protection laws to better serve you. For a list of local Western Union entities, please see Clause 13.19 titled “WESTERN UNION LEGAL ENTITIES.”

13.2 SCOPE OF THIS PRIVACY STATEMENT.

This Privacy Statement describes how Western Union collects, uses, protects and shares your personal information when you use our Services online through our website, in retail and through our mobile app, as well as your choices about the way your information is collected and used. Personal information means all information relating to an identified or identifiable individual.

13.3 PERSONAL INFORMATION WESTERN UNION COLLECTS.

When you use our Services, contact us, access our websites or applications or join our loyalty programs (collectively, the “Services”), we collect personal information about you and may use it along with other information collected or generated during our relationship with you. We collect different types of personal information relating to you, which may include:
• Contact information, for example your name, postal address, e-mail address, telephone number, and date of birth, gender, citizenship, occupation, marital status, and government or national identification numbers;
• Transaction information, including your money transfers and bill payments;
• Business related information that helps us provide our Services to you, such as membership in our loyalty programs, how you use of our Services, bank and credit information, and permissions to contact or marketing choices;
• Technical information, including the host from which you access the Internet, your IP address or device advertising ID, geolocation if enabled, information about your device (such as device properties, settings, applications, storage and usage information), mobile application, browser and operating system software, social profile and network information, the date and time you access our websites and the address of the site from which you linked to our website when you visit us. We collect personal information on your online activities as described in the section titled “INTERNET TECHNOLOGIES”;
• Compliance information, including fraud prevention, identity verification, and sanction checks.
To conduct a money transfer, or use other payment services, you must provide certain information required by Western Union to execute the transfer and to enable us to comply with our legal obligations associated with transferring money. Failure to provide some of your personal information may affect our ability to provide our Services to you. This may include information about the form of identification used to send or receive a transaction (where required by law) including the identification or a copy of the identification document, transaction activity, bank account and payment information.

13.4 HOW WESTERN UNION COLLECTS PERSONAL INFORMATION.

Western Union collects your personal information in several ways:
• Through transaction forms and your interactions with Western Union Agents and partners;
• Through online forms, registrations for loyalty and rewards programs or competitions, and other online Services we offer (some of which may be managed by third parties on behalf of Western Union);
• While providing customer support or consultation, including using email, postal mail, call centers or live chat;
• Through the process of maintaining and upgrading our Services;
• Through automated means such as communications protocols, e-mail communications and cookies or similar INTERNET TECHNOLOGIES;
• Through our mobile applications (some of which may be managed by third parties on behalf of Western Union);
• Through your use of social media or other public data sources; and
• Through your interest in Western Union advertisements placed on third party sites.
In addition to the personal information we collect from you, we may also collect your personal information from the person to whom you send and/or receive money, as well as our Agents, service providers, business partners, identity verification companies, payments and fraud risk management companies, law enforcement bodies, and commercial and public data sources.

13.5 HOW WESTERN UNION SECURES YOUR PERSONAL INFORMATION.

We endeavor to use reasonable organizational, technical and administrative safeguards that comply with applicable government laws and regulations to secure your personal information. We also endeavor to restrict information access to our employees, Agents and representatives that need to know it. Despite our efforts, and as you probably know, third parties may unlawfully intercept or access transmissions sent to us or may wrongly instruct you to disclose personal information to them while posing as Western Union. Please contact us immediately in accordance with Clause 13.17 titled “CONTACTING US” section, if you have reason to believe your personal information held by Western Union may be at risk.

13.6 INTERNET TECHNOLOGIES.

We use internet technologies like cookies, tags and web beacons on our websites, in mobile applications or when you visit a third-party website for which Western Union provides online Services for a variety of purposes, including, but not limited to those identified in Clause 13.7 titled “HOW WESTERN UNION USES THE PERSONAL INFORMATION IT COLLECTS”. Western Union has implemented the capability for the user to manage cookies on our websites. We may read or write cookies based on your preference level. (Note: cookies set prior to you changing your preference level are maintained on your computer; to remove them please refer to your browser settings and, if needed, your browser’s “Help” function.) 13.7 HOW WESTERN UNION USES THE PERSONAL INFORMATION IT COLLECTS.

Western Union utilizes the personal information it collects to:
• To assist us in providing Services to you and help you to receive a personalized experience and assist you in carrying out transactions and accessing account information;
• To recognize you and allow you to remain signed-in during your visit without having to re-enter your password;
• To perform analytics on understanding our customers, improving their experience;
• To determine whether you came to Western Union from a banner ad or an Affiliate;
• To deliver information specific to your interests on non-Western Union websites and applications;
• To better understand the effectiveness of our promotional campaigns and whether you acted on our promotional messages;
• To promote safety, reduce financial risk and combat fraud across our Services.

13.8 LEGAL BASES UPON WHICH WE COLLECT AND USE YOUR PERSONAL INFORMATION.

Western Union may collect and use your personal information as explained elsewhere in this Statement for each of the following legal bases:
• We use your personal information to provide our services to you: This includes using personal information necessary for conducting money transfers, payment services, prepaid cards, or loyalty programs. We may use this information in the performance of a contract with you or for taking steps to enter into a contract for any of the above or for any other Western Union products or services.
• We use your personal information for legitimate business purposes: This includes using personal information to analyze and improve our products, locations, services, operations, the running of this site and your customer experience, and for measuring marketing return on investment and brand satisfaction. This may include using your information to conduct market research surveys. We may also use your personal information to provide customer services and to help protect the security and integrity of our technology, systems, and services.
• We use your personal information for legal and compliance purposes: This includes using personal information needed to comply with legal and regulatory duties related to anti-money laundering and counter-terrorist financing; detection, prevention and prosecution of fraud and theft as well as preventing illegitimate or prohibited use of our services or other illegal or wrongful activity. This may also include establishing, exercising, or defending legal rights and claims of Western Union and others, and monitoring and reporting compliance issues. This may further include using your personal information to validate and authenticate your identity, and utilizing third parties to help us do so.
• We may process your personal information based on your consent as outlined in this Statement: This includes consent for receiving marketing communications, or where otherwise required by applicable law. If we request your consent, we will inform you of the intended purposes for which your information will be processed.
• We will inform you when your information is required to provide the services you request, or is required by law. In certain cases, such as performing money transfer services, we may be unable to provide you with our services unless you provide certain personal information.

13.9 HOW WESTERN UNION MARKETS TO ITS CUSTOMERS.

Western Union will also, subject to your consent, notify you of offers, promotions and updates regarding our products and Services. These may include offers by email, telephone, postal mail, SMS, social media and other communication or digital channels. You can opt out of receiving marketing communications at any time. If you no longer want to receive marketing-related communications from us on a going-forward basis, you may opt-out by following the instructions in the relevant electronic communication or by contacting us as described in Clause 13.17 titled “CONTACTING US”. Please note that if you opt-out of receiving marketing-related communications from us, we may still send you important service, administrative or transaction-related communications.

13.10 INFORMATION FROM CHILDREN.

Western Union does not direct our Services or products at children under the age of 13. Western Union does not knowingly collect or maintain information from our retail, website or mobile apps from persons under the age of 13.

13.11 EXTERNAL WEBSITES.

Western Union’s Website may be linked to or from third party websites. Western Union has not reviewed, does not control, and is not responsible for the content or privacy practices employed by websites that are linked to or from our website. Western Union does not assume responsibility for any of these sites, their content, or their privacy policies. Western Union does not endorse third party websites or make any warranties about any information, software or other products or materials you may find there, or any results that may be obtained from using them.

13.12 WHO WESTERN UNION SHARES YOUR DATA WITH.

For any of the purposes listed in this Statement, Western Union may disclose applicable personal information including, but not limited to, your name, contact information, national identification number, customer ID number, address, transaction patterns and bank account information to the following types of organizations or parties:
• Western Union group companies and affiliates, including those listed in Clause 13.19 titled “WESTERN UNION LEGAL ENTITIES”;
• Required local remittance licensing entities relevant to a transaction, including those listed in Clause 13.20 titled “NON-AFFILATE LOCAL LICENSING ENTITIES”;
• Our Agents or business partners who facilitate the money transfer transaction or specific service you have requested;
• Service providers, payments processors, banking partners and data processors contracted to provide business and customer services;
• Customer services, based on your consent where applicable, including marketing, advertising and customer satisfaction and market research on our behalf;
• Service providers and data processors contracted to help us validate the accuracy of the information provided by you, and to authenticate your identity and manage risks related to security, fraud and identity.
• Third parties that you have authorized to access your account and/or your account information in order to perform Services for you, such as account information service providers and payment initiation service providers.
We may transmit personal information we possess in connection with a sale or transfer of all or part of our business. We may also disclose your personal information globally, as required or permitted by applicable laws and regulations, to regulatory and financial authorities, law enforcement bodies, courts, governments or government agencies, to meet compliance and legal obligations or to assert or defend the rights and interests of Western Union or others.

13.13 INTERNATIONAL DATA TRANSFERS.

We transfer your information to parties in countries outside the country it was collected, including but not limited to the USA, as permitted or required by applicable law, regulatory authorities, law enforcement and government agencies. Additionally, when you send or receive money to or from another country, we will also be required to share some of your personal information with that country as required or permitted by law. We transfer certain personal information about you to our data centers located in the USA or within a region as required by local law and process it to fulfil our legal and compliance obligations which apply to our Services. We also store certain personal information we collect based on your marketing choices in our US data center. By using Western Union’s Services, you acknowledge that such transfers of information outside of your country of residence may occur.

13.14 TRANSFERS FROM THE EEA.

Personal information transferred outside the EEA to countries that the European Commission has not found to provide adequate protection will be protected by appropriate contractual clauses or other EU-approved mechanisms, as required by law. 13.15 RETENTION OF PERSONAL INFORMATION.

Your personal information will be retained in accordance with statutory periods contained in regulations applicable to financial transactions including those in anti-money laundering, anti-terrorist financing and other laws applicable to us. Otherwise, we will retain your information only if necessary for the specific purposes it was collected, or to resolve any query you may raise. We will typically keep your information for no longer than the purpose(s) for which it was obtained, unless we have a legal obligation to keep it for a longer period or retention is advisable for Western Union’s legal position (for example, regarding applicable statutes of limitations, litigation or regulatory investigations).

13.16 ACCESSING, DELETING AND CORRECTING YOUR PERSONAL INFORMATION AND CHANGING YOUR CHOICES.

You have the right to know if we are processing your personal information and to request information about the processing and ask us for a copy of your information free of charge. You have the right to learn the purpose of the processing and whether your data is used for intended purposes. You have the right to learn the third person(s) to whom the personal data is being transferred, domestically or abroad. You have the right to request a structured and machine-readable copy of certain information you have provided to us. We may charge you a reasonable fee for providing the information, or not act upon your request, if the request is manifestly unfounded or excessive. You have the right to stop us from sending you marketing communications. You have the right to ask us to correct information about you that is incomplete, inaccurate or out-of-date. You have the right to ask us to erase or destruct certain information about you in compliance with the conditions set out in the applicable legislation, to restrict certain uses of information relating to you, and also to object to certain uses of it. You have the right to request Western Union to inform third parties to which your personal data is transferred, of the data processing transactions conducted concerning the correction, revision and/or erasure of certain personal data. You have the right to object to any negative outcome caused by analyzing, in case where your personal data is analyzed exclusively by automated systems. You have the right to request compensation in cases where your personal data is processed against the law and you have incurred damages due to such illegal processing activity. To the extent we are processing personal information based on your consent, you may withdraw your consent as permitted by applicable law. Registered users may also visit westernunion.com and edit Profile settings. You also have the right to lodge a complaint with a relevant data protection regulator or supervisory authority about our processing of personal information. When we receive a request, we may ask for additional information from you to verify your identity. In some situations, we may refuse to act or may impose limitations on your rights, as permitted by applicable law. To exercise these rights, please visit our Data Subject Access Request Portal or contact Western Union through Clause 13.17 titled “CONTACTING US”. We will endeavor to respond to your request within 30 days but may be entitled to extend this period in certain circumstances. We will comply with your request to the extent required by applicable law.

13.18 CHANGES.
